Literally how you protect your work commissioning an artist to design paint draw on a project while his work still represents him to a degree the work done is not his property at the end of it all nor was it done for said artist just rediculous maybe should start looking at AI going forward so you don’t have babies boobing
You said the artist was paid in 2015 for their work? If that artist was paid for the work then Bungie has the rights to that artwork and can put it on that nerf gun. Its not like this was a mock up someone did and they didnt get paid. You said yourself numbers of time the artist WAS paid for the work they did!
If he’d created his own never existed before weapon and bungie ripped it off I’d say yeah they’ve got a case. But just copying bungie’s own stuff and sticking a few of your own touches doesn’t really make it yours 🤔
So let me get this straight…This artist used art of a Bungie related asset to make a fan rendition of something not owned by them, but by Bungie who decided not to go after them for using their intellectual property because they thought the design was neat. Only for Bungie to later use said art that was completely within their rights to use as it was always originally theirs and the artist in question is deciding to be a jerk instead of flattered?
Anyway bungie terms of service says that all art made from the game is their property no matter what you've done with it. Someone could make a nice skin for a weapon and bungie could put it in the game or in a brand with no legal problems.
Not enough of a difference to warrant a case! You can't put a hat on Mickey and change the color of his shoes and expect a judge to give you a pay out when you sue Disney!
Honestly don't see why this is now an issue whenever Bungie has made hundreds of weapon skins and no one's ever looked at them to a point of this detail. They could have many others on other weapons of similar sorts but dunno just seems so weird to make a skin so controversial, it doesn't even look good 😂
Dumbgie has been copycatting for all the 10yrs…who cares…they never have really been a creative mind on their own but that hasn't stop the game from selling and the community playing so this is old news and kinda the Dumbgie way anyhow.
Who knows what other companies took ideas from fan art secretly and decided to sell it as profit. The artist in this example has all rights to sue. Oh Bungie 🙂↕️
I am more curious how much bungie was involved in the nerf project. More than likely, nerf paid bungie to make replicas of the games gun(s), someone at nerf saw this image and liked it, and made the nerf gun based on this image not realizing it’s not a version of the bungie Ace of spades.
Ummm, I’m confused here.. Is the artist mad, or is it that people are mad for them? Because if the original artist is mad, why? You used Bungies gun and made it your own and drew all over it. That doesn’t make it your image. That makes it Bungies image but it just looks different. Or.. we are all wrong on this and by drawing on something to make it look it different automatically makes it yours. If they’re not mad and it’s just people mad for them, my statement stands but just for the people who are mad for the artist.
this is not theft. Bungie owns the IP for Ace of Spades. This "Community Artist" does not own the IP. BUT should Bungie acknowledge the artist? Yeah they should.
The Ace of Spades is Bungie's IP but does that mean any artistic renditions of it are also Bungie's IP?

is it bungie or nerf tho?
If they got paid for it already then there isn’t nothing you can do. Got to read those terms and services. Happens to much in the art world.
They can just sue him to oblivion for using an ip he doesn't own
Let’s also remember the last artist who’s work that was used in a cutscene has yet to get any forms of compensation 😂
Ok the artist didnt own it they need to stop crying
Question to those who ordered it mines already showing shipped and will be here monday or so am i the only one to get that?

Yea but whats the side by side of the gamemodel and concept art vs nerf vs random artist
Most likely this is Hasbro’s fault. And there’s only so many variants that you can do to a singular weapon.
If he’d created his own never existed before weapon and bungie ripped it off I’d say yeah they’ve got a case. But just copying bungie’s own stuff and sticking a few of your own touches doesn’t really make it yours 🤔
Ai is ripping off all art ever made…..yet those ai clowns think they are “artists”.
They own the ip……that artist owns nothing. The artist recreated their ip….
You guys really need to do a deep dive into intellectual property from trademarks, copyright, and patents.
This is not a change 3 things and it is all new…..
Sue Bungie, oh wait… 🤣

I can’t see any resemblance..

Ai is stealing from artists everyday
Pretty sure this isn’t the first time this has happened. There was one where the person who used the art claimed they thought it was bungie’s art.

This is reaching for sure….. The Destiny player base is just looking for any reason to be mad now. It’s getting old now for sure.
They should have just made this nerf design a skin for the ace of spades

Maybe there was nobody at bungie who could send an official ace of spades image so nerf had to google it and this is what they found
That guys entire design was one new red band on the loader and a bunch of scratches? No wonder it wasn’t added to the game.
Who knows what other companies took ideas from fan art secretly and decided to sell it as profit. The artist in this example has all rights to sue. Oh Bungie 🙂↕️
Quite a few design choices are very coincidental, because they are iconic NERF GUN DETAILS BRO

It's all good. No one's gonna buy it anyway bc engrams don't drop in Skywatch
Such BS. AoS is bungies IP. Then someone made a picture of their IP. Like gtfo.
Bro ripped off Bungie by working on their weapon. Not his own artwork. He can kma he aint owed a damn thing
cry me a river… idc
Ace of spade is 100% bungie fuk that guy

This is a far reach video.
Lol, how you can steal image from internet?
Bro stop baldo guarding for bungie.
They are a dog shit company. Accept that they fucking suck. Stop fucking supporting them bro.
The artist sure is full of themselves.
This is one of those times where i say "i dont care"
'The Artist' just wants to sue Bungie so he can get money from it, just a moneywolf
this is not theft. Bungie owns the IP for Ace of Spades. This "Community Artist" does not own the IP. BUT should Bungie acknowledge the artist? Yeah they should.
the artist is complaining for no reason, the ace of spades just looks like that.
