Literally how you protect your work commissioning an artist to design paint draw on a project while his work still represents him to a degree the work done is not his property at the end of it all nor was it done for said artist just rediculous maybe should start looking at AI going forward so you don’t have babies boobing

  2. You said the artist was paid in 2015 for their work? If that artist was paid for the work then Bungie has the rights to that artwork and can put it on that nerf gun. Its not like this was a mock up someone did and they didnt get paid. You said yourself numbers of time the artist WAS paid for the work they did!

  3. If he’d created his own never existed before weapon and bungie ripped it off I’d say yeah they’ve got a case. But just copying bungie’s own stuff and sticking a few of your own touches doesn’t really make it yours 🤔

    They own the ip……that artist owns nothing. The artist recreated their ip….

    You guys really need to do a deep dive into intellectual property from trademarks, copyright, and patents.

So let me get this straight…This artist used art of a Bungie related asset to make a fan rendition of something not owned by them, but by Bungie who decided not to go after them for using their intellectual property because they thought the design was neat. Only for Bungie to later use said art that was completely within their rights to use as it was always originally theirs and the artist in question is deciding to be a jerk instead of flattered?

  6. Anyway bungie terms of service says that all art made from the game is their property no matter what you've done with it. Someone could make a nice skin for a weapon and bungie could put it in the game or in a brand with no legal problems.

  7. Honestly don't see why this is now an issue whenever Bungie has made hundreds of weapon skins and no one's ever looked at them to a point of this detail. They could have many others on other weapons of similar sorts but dunno just seems so weird to make a skin so controversial, it doesn't even look good 😂

  8. Dumbgie has been copycatting for all the 10yrs…who cares…they never have really been a creative mind on their own but that hasn't stop the game from selling and the community playing so this is old news and kinda the Dumbgie way anyhow.

  9. I am more curious how much bungie was involved in the nerf project. More than likely, nerf paid bungie to make replicas of the games gun(s), someone at nerf saw this image and liked it, and made the nerf gun based on this image not realizing it’s not a version of the bungie Ace of spades.

  10. Ummm, I’m confused here.. Is the artist mad, or is it that people are mad for them? Because if the original artist is mad, why? You used Bungies gun and made it your own and drew all over it. That doesn’t make it your image. That makes it Bungies image but it just looks different. Or.. we are all wrong on this and by drawing on something to make it look it different automatically makes it yours. If they’re not mad and it’s just people mad for them, my statement stands but just for the people who are mad for the artist.
